Dear Ambassador Warlick:

We are writing out of concern over the escalation of violence in Nagorno-Karabakh, resulting in deaths on both sides of the conflict. It is our hope that the United States, through its role in the Organization for Security and Cooperation in Europe’s (OSCE) Minsk Group, as well as through direct diplomacy with both Armenia and Azerbaijan, will immediately advocate for several steps to promote peace in the region.

We believe that securing the full and public support of Azerbaijan, Armenia, and Nagorno-Karabakh for the following steps would, in the short-term, save lives and help to avert war. Over the longer term, these steps could contribute to a comprehensive and enduring peace for all the citizens of the region.

An agreement from all sides not to deploy snipers along the line of contact.

The placement of OSCE-monitored, advanced gunfire-locator systems and sound-ranging equipment to determine the source of attacks along the line of contact.

The deployment of additional OSCE observers along the line of contact to better monitor cease-fire violations.

We also urge you to publicly condemn specific acts of aggression along the line of contact. The longstanding U.S. and OSCE practice of responding to each new attack with generic calls upon all parties to refrain from violence has failed to de-escalate the situation. Instead, this policy of artificial evenhandedness has dangerously increased tensions. There will be no peace absent responsibility.

Thank you for your consideration of these recommendations. We continue to support your efforts to reach a durable and just resolution to this conflict and look forward to your response.

WASHINGTON — The United States is “not satisfied” with explanations from Baku and Budapest concerning the case of an Azerbaijani officer who brutally murdered an Armenian soldier at a NATO seminar in Hungary eight years ago.

Philip Gordon, the U.S. Assistant Secretary of State for European and Eurasian Affairs, told RFE/RL at the Center for European Policy Analysis’ U.S.-Central Europe Strategy Forum on September 20 that Washington continues to express “dismay and disappointment” to Budapest about its decision to release Ramil Safarov to Baku.

He said Washington is sending the same message to Azerbaijan’s government, which pardoned Safarov and then promoted him after his August 31 return to the country.

“We were appalled by the glorification that we heard in some quarters of somebody who was convicted of murder,” Gordon said. He called the case “a real provocation in the region.”

The European Union, the OSCE’s Minsk Group, Russia, and Hungary also expressed concern about Safarov’s pardon and promotion.

President Obama is deeply concerned by today’s announcement that the President of Azerbaijan has pardoned Ramil Safarov following his return from Hungary. Safarov confessed to the murder of Armenian Army officer Gurgen Margaryan in Budapest in 2004, and was serving a life sentence in Hungary for this brutal crime. We are communicating to Azerbaijani authorities our disappointment about the decision to pardon Safarov. This action is contrary to ongoing efforts to reduce regional tensions and promote reconciliation. The United States is also requesting an explanation from Hungary regarding its decision to transfer Safarov to Azerbaijan.

The United States is extremely troubled by the news that the President of Azerbaijan pardoned Azerbaijani army officer Ramil Safarov, who returned to Baku today following his transfer from Hungary. Mr. Safarov had been serving a life sentence in a Hungarian jail for murdering Armenian officer Gurgen Margaryan during a 2004 NATO training event in Budapest.

We are expressing our deep concern to Azerbaijan regarding this action and seeking an explanation. We are also seeking further details from Hungary regarding the decision to transfer Mr. Safarov to Azerbaijan.

We condemn any action that fuels regional tensions.

Ms. Štiglic (Slovenia): The European Union recognizes the right of Member States to bring issues to the attention of the General Assembly for consideration, subject to the provisions of the Charter of the United Nations and the rules and procedures of the General Assembly.

However, the European Union believes that the Organization for Security and Cooperation in Europe (OSCE) Minsk Group should retain the lead in settling the Nagorny Karabakh conflict. The EU fully supports the efforts of the OSCE Minsk Group towards a peaceful, just and lasting settlement. The EU reiterates its support for all the principles, without exception, established within the Minsk Group and values the views of the Group’s Co-Chairs.

The settlement of the Nagorny Karabakh issue is an important element of the European Neighbourhood Policy of the European Union and features prominently in the related action plans. In that context, we remain ready to support all steps which contribute to a peaceful resolution of the conflict.

The European Union calls on the parties concerned to avoid any actions that could lead to heightened tensions and undermine the ongoing mediation efforts.

 

Mr. Wolff (United States of America): The political-level representatives of France, the Russian Federation and the United States, as Co-Chairs of the Organization for Security and Cooperation in Europe (OSCE) Minsk Group dealing with the Nagorny Karabakh conflict, jointly proposed a set of basic
principles for the peaceful settlement of the Nagorny Karabakh conflict to the sides in November 2007 on the margins of the OSCE Ministerial Council in Madrid. Those basic principles are founded on the provisions of the Helsinki Final Act of the Conference on Security and Cooperation in Europe, including those related to refraining from the threat or use of force, the territorial integrity of States and the equal rights and self-determination of peoples. The proposal transmitted to the sides in Madrid comprises a balanced package of principles that are currently under negotiation. The sides have agreed that no single element is agreed until all elements are agreed by the parties.

Unfortunately, the draft resolution before us today selectively propagates only certain of those principles, to the exclusion of others, without considering the Co-Chairs’ proposal in its balanced entirety. Because of this selective approach, the three OSCE Minsk Group Co-Chair countries must oppose this unilateral draft resolution. They reiterate that a peaceful, equitable and lasting settlement of the Nagorny Karabakh conflict will require unavoidable compromises among the parties that reflect the principles of territorial integrity, non-use of force and equal rights of peoples, as well as other principles of international law.

While the three Minsk Group Co-Chair countries will vote against this unilateral draft resolution, which threatens to undermine the peace process, they reaffirm their support for the territorial integrity of Azerbaijan and thus do not recognize the independence of Nagorny Karabakh. At a time when serious clashes with loss of life have occurred along the line of contact, both sides must refrain from unilateral and maximalist actions either at the negotiating table or in the field.

 

Mr. Ripert (France) (spoke in French): As just stated by the representative of the United States of America on behalf of the Co-Chairs of the Minsk Group, France, along with the other two Co-Chairs, will vote against the draft resolution that has been unilaterally presented by Azerbaijan. Our country would reaffirm at the same time our full support for the Common Position of the European Union on the question of the Nagorny Karabakh conflict, as presented by Slovenia.

Sec. 907. RESTRICTION ON ASSISTANCE TO AZERBAIJAN.

(a) RESTRICTIONS – United States assistance under this or any other Act (other than assistance under title V of this Act) may not be provided to the Government of Azerbaijan until the President determines, and so reports to the Congress, that the Government of Azerbaijan is taking demonstrable steps to cease all blockades and other offensive uses of force against Armenia and Nagorno-Karabakh.

(b) WAIVER- The restriction on assistance in subsection (a) shall not apply if the President determines, and so certifies to Congress, that the application of the restriction would not be in the national interests of the United States.

RESOLUTION

Condemning violence in Armenia.

Whereas the Government of the Soviet Union and Government of the Azerbaijan Republic have dramatically escalated their attacks against civilian Armenians in Nagorno-Karabakh, Azerbaijan, and Armenia itself;

Whereas the Government of the Soviet Union has refused Armenia’s request to convene a special session of the Union of Soviet Socialist Republics Supreme Soviet to resolve the Nagorno-Karabakh crisis;

Whereas Soviet and Azerbaijani forces have destroyed Armenian villages and depopulated Armenian areas in and around Nagorno-Karabakh in violation of internationally recognized human rights; and

Whereas armed militia threaten stability and peace in Armenia, Nagorno-Karabakh, and Azerbaijan: Now, therefore, be it

Resolved, That it is the sense of the Senate that the Senate–

  1. condemns the attacks on innocent children, women, and men in Armenian areas and communities in and around Nagorno-Karabakh and in Armenia;
  2. condemns the indiscriminate use of force, including the shelling of civilian areas, on Armenia’s eastern and southern borders;
  3. calls for the end to the blockades and other uses of force and intimidation directed against Armenia and Nagorno-Karabakh, and calls for the withdrawal of Soviet forces newly deployed for the purpose of intimidation;
  4. calls for dialogue among all parties involved as the only acceptable route to achieving a lasting resolution of the conflict; and
  5. reconfirms the commitment of the United States to the success of democracy and self-determination in the Soviet Union and its various republics, by expressing its deep concern about any Soviet action of retribution, intimidation, or leverage against those Republics and regions which have chosen to seek the fulfillment of their political aspirations.
